Q: What will happen to the park?
A: The City of NLR has committed to maintaining it.
From the Feb. 9th meeting: Mayor Hartwick said if IHCC turns the park over to the city, the city will keep it mowed and lit. But he also talked about repairing the tennis courts and adding a pickleball court. The pool would be filled in. His comment was basically, if the city takes it over it becomes the cities -- meaning it's open to everyone.
This sparked concern about "crimes, drugs, vandalism, etc". However, it was reported last night that vandalism and crime (illegal dumping) is already happening at the park right now.
Q: If it becomes a city park, won’t “bad elements” move in?
A: It’s currently a private park and vandalism is ALREADY happening according to IHCC. (see above)
Q: Public vs. Private
A: The property is considered private now and there are NO enforcement mechanisms to ensure only Indian Hills residents are using the properties (other than the tennis court).
This is no different than if the properties were already public.
Residents who benefit the most from the property remaining private are those living on/near the park and lakes.
At the most recent IHCC USD meeting one of the board members fully admitted to taking their kids to the Lakewood park “despite not being members”.
Proving —— the idea of the amenities only being for members is unenforceable.
Q: What will happen to the lakes?
A: NLR City Council has stated the lakes are important for ALL of NLR for storm water retention and drainage.
The City has a vested interest in maintaining the lakes.

Q: If the NLR City doesn’t take the lake property what else could happen?
A: In the unlikely event the city doesn’t take the lake property - the city has a vested interest in maintaining the levees for downstream safety (as stated in the SALT Engineering report).
If the USD doesn’t pass, IHCC will likely dissolve.
After a few years of non-payment for property tax, the property could go up for sale.
Indian Hills residents WOULD NOT be liable for the unpaid property taxes.

What developer would purchase property with ~19 feet access between two private homes (lower lake/ left image) and a 13 foot boat ramp (upper lake/right image) access to each lake?
Also consider the fact —- if they were to purchase the land and drain the lakes — they would HAVE TO reroute ALL the current storm / water drainage for both lakes into the Five Mile Creek. This would come at a considerable cost.
